The Americans with Disabilities Amendment Act was passed in 2008 in response to Supreme Court decisions in the late 90s that had too narrowly interpreted the ADA’s definition of a disability.
The ADAA amends only the ADA and Section 504 and broadens the definition of “disability” and what constitutes a “substantial limitation of a major life activity.”
The ADAA creates a more relaxed legal standard for establishing eligibility for receiving auxiliary aids and services in higher education institutions. As a result, a higher education institution’s DSS office should not need or require extensive documentation or analysis to determine that a student has a disability.
